Constructive dismissal
Constructive dismissal occurs when an employee feels forced to resign due to their employer’s actions or treatment.
When you’re the target of things like bullying, breach of contract, or a failure to address other serious matters, you may truly believe that you have no choice but to leave your employment. If that’s the case, you might be entitled to claim constructive dismissal.
Our experienced employment solicitors can guide you through the constructive dismissal process, helping you determine whether your resignation was, in fact, a result of your employer’s unlawful conduct and whether you have a case for constructive dismissal compensation.
Employment rights
Your employment rights are the legal protections that apply to you as an employee or worker. Whether it’s related to working hours, pay, holiday entitlement, or protection from unfair treatment, your rights are vital to ensure a fair and just working environment.
If your employer has violated these rights, we provide expert legal advice to help you understand your options and take action if necessary.
Employment tribunals
If you have a dispute that can’t be resolved through negotiation or other means, you may need to take your case to an employment tribunal. While we don’t actually represent individuals at an employment tribunal (you will usually have a barrister for that), we are experts in helping clients prepare for tribunal hearings.
Our team can guide you through the legal process, ensuring that you fully understand it, and are prepared for each step along the way to the tribunal.
Redundancy
Redundancy can be a confusing and stressful process, especially if you feel you’ve been unfairly selected or your employment rights have not been respected.
Whether you are unsure about whether your redundancy is genuine or believe you’ve been treated unfairly during the process, our employment lawyers can offer comprehensive employment law advice. We’ll help you understand your entitlements, such as redundancy pay, and whether your employer has followed the correct procedure.

Settlement agreements
A settlement agreement is a legally binding contract that usually involves an offer of financial compensation in exchange for you agreeing not to bring any further claims against your employer.
We offer you two different types of service relating to settlement agreements:
1] Settlement agreement negotiations
This service is where Monaco Solicitors negotiate a settlement agreement on your behalf, starting from the time you first approach us to tell us about your employment issue.
We assess whether you have a good legal case which means you can claim compensation for being unfairly and/or badly treated by your employer.
If you have, we agree on the terms for representing you – No Win No Fee if possible – and then work closely with you to negotiate a financial settlement agreement on your behalf with your employer.
2] Settlement agreement review and advice
If your employer has offered you a settlement agreement, it’s a legal requirement for you to have suitably qualified employment law advice before you sign the agreement.
Our experienced employment lawyers are all exceptionally well qualified to review the terms of your settlement agreement. They can also often negotiate an improved deal for you with your employer if you are being under compensated.
Monaco Solicitors is an established employment law firm, so we have all the insurance and other legal liability cover needed to competently and professionally review such an important legal document. We will ensure that your interests are fully protected and that you receive the best possible settlement.
Unfair dismissal
If you’ve been dismissed from your job and believe the dismissal was unfair, you may have grounds to claim for unfair dismissal. There are strict legal rules in place for how and why an employer can dismiss an employee, and if these rules haven’t been followed, you could be entitled to compensation.
Our employment solicitors are here to help you determine whether your dismissal was unjust and to support you in bringing an unfair dismissal claim.
Workplace Discrimination
Workplace discrimination is illegal in the UK, and employees are protected by the Equality Act 2010. If you’ve faced discrimination due to your race, gender, sex, disability, age, or any other ‘protected characteristic’, we can help you challenge it.
Whether it’s been a one-off incident or part of a pattern of behaviour, our expert employment lawyers will ensure that your case is handled with the sensitivity and diligence it deserves.

Employment law FAQs
Here are some frequently asked questions about aspects of employment law and the services we offer, together with very brief answers. You can find more detail in the guides highlighted in the answers and on our website.
What does an employment law solicitor do for employees?
An employment law solicitor provides legal advice, representation and other legal services to employees who are facing issues such as unfair treatment, discrimination, or dismissal at work. They provide you with such support as employee rights legal advice, settlement agreement negotiations, help with preparing for employment tribunals, and guidance through the complexities of employment law.
What are my rights if I’m facing workplace discrimination?
If you’re facing workplace discrimination, you are protected by the Equality Act 2010. This law prohibits discrimination based on race, gender, disability, age, religion, or other protected characteristics. You have the right to take legal action if you’re being treated unfairly because of any of these factors.
Can I bring a claim for constructive dismissal?
Yes, you can bring a claim for constructive dismissal if your employer’s actions or treatment have made it impossible for you to continue working, and you were forced to resign. However, you must have tried to resolve the issue with your employer first and be able to prove that your resignation was due to their conduct.
Can I challenge an unfair dismissal?
Yes, if you believe you were dismissed unfairly, you can challenge the dismissal. There are strict rules on how and why an employer can dismiss an employee, and if these rules are not followed, you may be entitled to compensation. You can seek compensation out-of-court by means of a settlement agreement, or if necessary by bringing an unfair dismissal claim to be heard by an employment tribunal.
What are my rights during a redundancy process?
During a redundancy process, you have the right to fair treatment, including the right to be consulted about the redundancy, the right to be considered for other roles within the company, and the right to redundancy pay if you meet the criteria. You must also be given sufficient notice and the right to appeal the decision if necessary.
What should I do if I’m being harassed or bullied at work?
If you’re being harassed or bullied at work, it’s important to document the incidents and report them to your employer through the appropriate channels, such as HR. If the issue isn’t resolved internally, seeking legal advice from employment law solicitors such as Monaco Solicitors can help you understand your options and take further action if necessary.
What is the process for making an employment tribunal claim?
Making an employment tribunal claim involves submitting a claim form (called an ET1) to the tribunal which details your case as a Claimant against your employer (the Respondent).
You will need to have evidence to support your claim and may need to attend an employment tribunal hearing. Before filing your claim, you may be required to go through what’s called ‘early conciliation’ with Acas (Advisory, Conciliation and Arbitration Service) in an attempt to resolve the dispute.
Do I need a solicitor to review a settlement agreement?
You must have a qualified specialist lawyer, certified trade union official or advice centre worker to review any settlement and advise you on it before you sign it. They must also have the correct indemnity insurance in case things go wrong.
Given the complexity of such agreements and of the employment law that apply to them, it’s highly recommended that you use specialist employment solicitors such as Monaco Solicitors, for your settlement agreement review.
We will ensure that the terms are fair, that you understand your employment law rights, and that you are not foregoing any legal claims unintentionally. There is also usually no charge for this service, as it’s paid for by your employer.
